Terms and Conditions

To use our Service, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Be responsible for maintaining the confidentiality of your account credentials
• Be responsible for all activities that occur under your account

You may not create multiple accounts or allow others to use your account.

Words for Tomorrow is a subscription-based digital letter delivery service that enables users to create encrypted messages to be delivered to specified recipients under predetermined conditions, including heartbeat monitoring or scheduled delivery dates.

The Service includes:

• Letter composition and editing tools
• End-to-end encryption with AES-256 standards
• Secure storage of encrypted content
• Automated delivery systems based on user-defined triggers
• Recipient authentication via secret questions

Subscription Fee: The Service is provided on an annual subscription basis at $25.00 USD per year, charged in advance.

Auto-Renewal: Your subscription will automatically renew on the anniversary of your initial subscription date unless you cancel before the renewal date. You will be charged the then-current subscription fee.

Payment Processing: All payments are processed through our third-party payment processor. You authorize us to charge your designated payment method for all applicable fees.

International Payments: For customers outside the United States, your payment method may be charged in your local currency at the prevailing exchange rate. Currency conversion fees, if any, are determined by your bank or payment provider.

Price Changes: We reserve the right to modify subscription fees with 30 days' advance notice to existing subscribers. Price changes will apply to subsequent billing cycles.

Taxes and VAT: You are responsible for any applicable taxes, duties, VAT, or government fees in your jurisdiction. For EU customers, VAT may be added to your subscription fee where required by law.

Failed Payments: If payment fails, we may suspend or terminate your account after reasonable notice and opportunity to cure.

Unpaid Account Access: If your subscription lapses or payment fails, your account will be converted to read-only access. You will be able to view your existing letters and delete them, but you will not be able to create new letters or edit existing letters. However, previously scheduled letters will continue to be delivered as configured.

Global Service: Words for Tomorrow is available to users worldwide. By using our Service from outside the United Kingdom, you acknowledge that your data may be transferred to and processed in the UK and other countries where we operate.

Local Laws: You are responsible for ensuring your use of the Service complies with all applicable local laws and regulations in your jurisdiction.

Language: The Service is provided in English. All communications, including support, will be conducted in English.

Time Zones: Scheduled letter deliveries occur at the beginning of the selected date in your local time zone as detected by your device. All other dates and times in the Service are displayed in your local time zone based on your device settings.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation will take effect at the end of your current billing period.

Refund Policy: Annual subscription fees are generally non-refundable. However, we may provide prorated refunds in cases of service failure or other exceptional circumstances at our sole discretion.

Post-Cancellation: Upon cancellation, you will retain access to the Service until the end of your current billing period. Scheduled letters will continue to be delivered as configured unless you specifically delete them.

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Send threatening, harassing, defamatory, or abusive content
• Distribute spam, malware, or other harmful code
• Infringe upon intellectual property rights
• Engage in fraud, identity theft, or impersonation
• Interfere with or disrupt the Service or its security features
• Attempt to gain unauthorized access to other accounts or systems
• Use the Service for commercial purposes without authorization

Your Content: You retain ownership of all content you create and submit through the Service. By using the Service, you grant us a limited license to store, encrypt, and deliver your content as necessary to provide the Service.

Content Standards: You are solely responsible for your content and warrant that it does not violate these Terms or applicable laws.

Data Security: We implement industry-standard security measures, including AES-256 encryption. However, no method of transmission or storage is 100% secure.

Data Retention: We retain your data as necessary to provide the Service and comply with legal obligations.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

When you use secret questions, your letter content is encrypted with zero-knowledge architecture, meaning we cannot access the contents of your protected messages.

Availability: While we strive to maintain continuous service availability, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

Service Changes: We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice when possible.

Force Majeure: We are not liable for any failure to perform due to circumstances beyond our reasonable control.

Service "As Is": THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Not Legal Documents: Words for Tomorrow is a personal messaging service. Letters sent through our platform are personal communications and should not be considered legally binding documents such as wills, trusts, contracts, or official legal notices.

Liability Limitation: TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.

Critical Limitations: We cannot guarantee delivery timing, recipient response, or that recipients will be able to answer secret questions correctly.

Your Right to Terminate: You may terminate your account at any time through your account settings or by contacting support.

Our Right to Terminate: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for other legitimate business reasons.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable period, except where retention is required by law.

Our Rights: The Service, including its design, functionality, trademarks, and underlying technology, is protected by intellectual property laws and is owned by Words for Tomorrow.

Your Rights: You retain all rights to the content you create. We do not claim ownership of your letters or personal information.

License to Use: We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

Governing Law: These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Dispute Resolution: Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales. We encourage you to contact us first to try to resolve any disputes informally.

Class Action Waiver: You agree that disputes must be brought individually and not as part of a class action or collective proceeding.

We may modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using the Service and may cancel your subscription.

Severability: If any provision of these Terms is found unenforceable, the remainder will remain in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Words for Tomorrow.

No Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.

Assignment: You may not assign these Terms without our written consent. We may assign these Terms at any time.
